Nebraska officials on Wednesday announced a lawsuit against Colorado, alleging the Centennial State is allowing “unlawful water diversions” from a transboundary resource. Nebraska Gov. Jim Pillen (R) and state Attorney General Mike Hilgers (R) accused Colorado of threatening Nebraska’s water supply along the South Platte River in multiple ways.

Nebraska is taking Colorado to the U.S. Supreme Court over a dispute involving the 1923 South Platte River Compact, which governs how the two states share water.

The Perkins County Canal Project has generated tension between the states since 2022. Attorney General Phil Weiser threatened legal action over Nebraska’s use of eminent domain
